This Privacy Notice explains how Women’s Health Platform, Inc. dba Era Institute (“Era Institute”, “we”, “us”, or “our”) handles Personal Information (i.e., information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household) collected through the Era Institute website (www.erawomenshealth.com) and other websites that link to this Privacy Notice (each a “Website”).

This Privacy Notice does not apply to “protected health information” subject to the Health Insurance Portability and Accountability Act (“HIPAA”). Instead, such information is subject to the Era Institute’s Notice of Privacy Practices.

We may update this Privacy Notice from time to time. Any updated Privacy Notice will be effective when posted. Please check this Privacy Notice periodically for updates. If required by law, we will contact you directly to provide you with an updated Privacy Notice.

How do we collect Personal Information about you?

We collect Personal Information about you from the following sources:

We may collect Personal Information you provide to us directly, such as when you sign up for email updates.

When you use the Websites, we may collect the following types of Personal Information:

  • Direct Identifiers

We collect information that directly identifies you, such as your name, postal address, email address, phone number, and IP address.

How do we use Personal Information?

We may use Personal Information for the following purposes:

For example, we may use Personal Information if we acquire assets of another business, or sell or transfer all or a portion of our business or assets including through a sale in connection with bankruptcy and other forms of corporate change.

In addition to the above Personal Information uses, we will use your information when we have your consent to do so.

We may use anonymized, de-identified, or aggregated information for any purpose permitted by law.

How do we share Personal Information?

We may share Personal Information with the following categories of third parties:

  • With affiliates and subsidiaries 

We may share Personal Information with our parent entities, corporate affiliates, subsidiaries, business units, and other companies that share common ownership.

  • With third parties that help us power our Websites

We have a limited number of third-party service providers that help us run various aspects of our business. These service providers are contractually bound to protect Personal Information and to use it only for the limited purpose(s) for which we share it with them.

  • With third parties and the government when legal or enforcement issues arise

We may share Personal Information, if reasonable and necessary, to (i) comply with legal processes or enforceable governmental requests, or as otherwise required by law; (ii) cooperate with third parties in investigating acts or omissions that violate this Privacy Notice or the Terms of Service; or (iii) bring legal action against someone who may be violating the Terms of Service or who may be causing intentional or unintentional injury or interference to the rights or property of Era Institute or any third party, including other users of our Websites.

We may share Personal Information with third parties that provide us professional advisory services, including but not limited to, our lawyers, auditors, accountants, or banks.

  • With third parties in connection with corporate change

We may share Personal Information with third parties in the event of a reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business (including in connection with any bankruptcy or similar proceedings).

Do-Not-Track

Some browsers have incorporated Do Not Track (“DNT”) preferences.  At this time, we do not honor Do Not Track signals.

Security and Retention of Personal Information

We maintain reasonable security safeguards to protect Personal Information from unauthorized use or disclosure. However, no security measures or communications over the Internet can be 100% secure, and we cannot guarantee the security of your information. 

Your Personal Information will be retained as long as necessary to fulfill the purposes we have outlined above unless we are required to do otherwise by applicable law. This includes retaining your Personal Information to provide you with the products or services you have requested and interact with you; maintain our business relationship with you; improve our business over time; ensure the ongoing legality, safety and security of our Websites and relationships; or otherwise in accordance with our internal retention procedures. Once you have terminated your relationship with us, we may retain your Personal Information in our systems and records in order to ensure adequate fulfillment of surviving provisions in terminated contracts or for other legitimate business purposes, such as  to enable easier future user onboarding, demonstrate our business practices and contractual obligations, or provide you with information about our products and services in case of interest. Children’s Privacy

We do not knowingly collect information, including Personal Information, directly from children under the age of 13 through our Websites. If you believe that we have inadvertently collected Personal Information from a child under the age of 13 through our Websites, please contact us using the information in the Contact Us section below, and we will take prompt steps to delete the information.

Links to Other Sites

The Websites may contain links to websites or other services that are owned or operated by third parties (each, a “Third-party Service”). Any information that you provide on or to a Third-party Service or that is collected by a Third-party Service is provided directly to the owner or operator of the Third-party Service and is subject to the owner’s or operator’s privacy policy. We do not control and are not responsible for any Third-party Service. Inclusion of, linking to, or permitting the use or installation of any Third-Party Service does not imply approval or endorsement thereof by us. We encourage you to carefully review the privacy policies of all Third-party websites that you access.

California Residents

If you are a California resident, you may opt out of sharing your Personal Information subject to California Civil Code §1798.83 (the “Shine the Light law”) with third parties for those third parties’ direct marketing purposes by sending us an email at membership@erawomenshealth.com. Please note, however, that Era Institute does not disclose your Personal Information to any third party for their direct marketing purposes.

We are not subject to the California Consumer Privacy Act (CCPA) as of the effective date of this Privacy Notice.
